Oregon Man Fined $500 for Challenging Timing on Red-Light Cameras – Article by Melissa Quinn

Mats Jarlstrom’s trouble all began with a red-light camera.

In April 2013, Jarlstrom’s wife, Laurie, received a ticket after driving her Volkswagen through an intersection in Beaverton, Oregon, that was equipped with a traffic camera.

His wife paid the fine, but the timing of the traffic lights at the intersection piqued Jarlstrom’s interest, so he decided to look into a formula created in 1959 to calculate the length of yellow lights.

Jarlstrom says he realized the original formula failed to take into account the extra time it takes for a car to slow before making a right-hand turn safely.

“Currently, people are getting tickets for running red lights because they’re slowing down when they’re making turns,” he tells The Daily Signal. “It’s a safety issue because any time we run a red light, we’re in the intersection for the wrong reason, and there is cross traffic, and especially pedestrians are in danger.”

Jarlstrom, an electronics engineer from Sweden, revised the formula to take the deceleration into account, and decided to take his findings public.

But doing so, he quickly learned, came with a risk, and a costly one at that.

Jarlstrom shared his findings with local media, policymakers, the sheriff, and Alexei Maradudin, who helped craft the original mathematical formula in 1959. He also emailed his theory to the Oregon State Board of Examiners for Engineering and Land Surveying, in hopes it would take a look at his research.

The Oregon panel said it didn’t have any jurisdiction over traffic lights. But it did have jurisdiction over the state’s engineering laws. And it decided to open an investigation into Jarlstrom because of “his use of the title ‘electronics engineer’ and the statement ‘I’m an engineer,’” according to an order from the board.

After investigating Jarlstrom for two years, the board fined him $500.

The reason?

Jarlstrom, according to the board, practiced engineering without a license each time he “critiqued” the traffic-light system and identified himself as an engineer in correspondence with the panel.

“You don’t need to be an engineer to understand this,” Jarlstrom says in an interview with The Daily Signal, adding:

I read something that was already public and understood it, and I wanted to share that information with the public talking about it. I felt completely shocked when I contacted them that they weren’t interested in listening to the problems that I presented to the board. They accused me of being illegal by saying I was a Swedish electronics engineer.

Jarlstrom paid the $500 fine, and the board closed its investigation. But now, the public-interest law firm Institute for Justice is fighting alongside the Oregon man in federal court to challenge the state’s engineering laws.

“The issues are classic First Amendment issues,” Sam Gedge, an Institute for Justice lawyer who is representing Jarlstrom, tells The Daily Signal. “The government can’t punish people for expressing their concerns. The government can’t take words and redefine them and then punish people for using them in a way the government doesn’t like.”

‘Unusual’

Jarlstrom does have education and experience in engineering.

He has a degree in electronics engineering from Sweden, which is the equivalent of a bachelor’s degree in engineering in the United States.

Jarlstrom, 56, also worked for Luxor Electronics before immigrating to the United States in 1992.

But in Oregon, anyone who engages in “creative work requiring engineering education, training, and experience” under the state Professional Engineer Registration Act is required to be licensed as a professional engineer.

Nearly every state requires professional engineers to have a license. However, those licenses typically are reserved for engineers who build skyscrapers or design electrical plans for buildings.

The Institute for Justice is challenging the vague definition of what constitutes a professional engineer in Oregon, which in effect allows the board to regulate the exchange of ideas and of the word “engineer,” Gedge says:

What makes Oregon so unusual is they’ve taken the licensing regime for professional engineers and are applying it to people like Mats, who are talking about issues that concern them. That’s unusual.

There are two issues for Jarlstrom, Gedge says: He used the word “engineer” to describe himself, and he talked about technical topics.

“There have been a number of instances about the board going after people simply because they used the word engineer to describe themselves,” the lawyer says. “There are also examples of the board going after people who have never used the word engineer to describe themselves, but are nonetheless going out in public and speaking about technical topics.”

“That word isn’t off-limits to people,” he says. “The laws can’t be used to stop people from sending an email to his sheriff for safety.”

Other Incidents

Indeed, Jarlstrom’s experiences with Oregon’s Board of Examiners for Engineering and Land Surveying aren’t exclusive to him.

Last year, the board opened an investigation into Allen Alley, a Republican gubernatorial candidate, who stated in campaign ads: “I’m an engineer and a problem solver.”

Alley received a bachelor of science in mechanical engineering from Purdue University and worked as an engineer for Ford and Boeing. But he isn’t a licensed professional engineer in Oregon.

The board’s investigation into Alley is ongoing.

In another instance, the panel investigated a woman profiled in Portland Monthly’s “Oregon Woman 2015” edition.

Included in the magazine was an article about Marcela Alcantar and a headline about “the incredible story of the engineer behind Portland’s newest bridge.”

The board opened a “law enforcement case” against Alcantar based on the line, since she wasn’t a registered professional engineer.

Ultimately, the case was closed after the board’s staff spoke with the journalist who wrote the article. The board determined “engineer” was a designation given not by Alcantar, but by the article’s editors.

“The definition of the practice of engineering is so broad according to the board, and the board has shown itself to be so aggressive,” Gedge says. “Expressing your concerns on technical topics certainly leaves you at the risk of being investigated.”

‘Whistleblower’

Although Jarlstrom ultimately paid the fine, he says he believes the board’s decision violated his freedom of expression.

And while he does have engineering experience, Jarlstrom contends the skills he used to craft his revised formula relied on 6th- and 7th-grade math:

It’s interesting that just because students here in Beaverton or elsewhere are using math and looking at some traffic-flow issues in school, they would be considered practicing engineering according to the board. We can’t have laws having that kind of power or overreach.

Jarlstrom says he considers himself a whistleblower and is surprised something like this could happen in the United States. But he vows to continue working to “improve our civil rights and freedom of speech so individuals like myself can share ideas, whether they’re good or bad.”

“We still need to be able to express them,” he says. “If we can’t, there won’t be any ideas to choose from.”

Remember peak oil? Remember when oil prices were $140 a barrel and Goldman Sachs predicted they would soon reach $200? Now, the latest news is that oil prices have gone up all the way to $34 a barrel. Last fall, Goldman Sachs predicted prices would fall to $20 a barrel, which other analysts argued was “no better than its prior predictions,” but in fact they came a lot closer to that than to $200.

Low oil prices generate huge economic benefits. Low prices mean increased mobility, which means increased economic productivity. The end result, says Bank of America analyst Francisco Blanch, is “one of the largest transfers of wealth in human history” as $3 trillion remain in consumers’ pockets rather than going to the oil companies. I wouldn’t call this a “wealth transfer” so much as a reduction in income inequality, but either way, it is a good thing.

Naturally, some people hate the idea of increased mobility from lower fuel prices. “Cheap gas raises fears of urban sprawl,” warns NPR. Since “urban sprawl” is a made-up problem, I’d have to rewrite this as, “Cheap gas raises hopes of urban sprawl.” The only real “fear” is on the part of city officials who want everyone to pay taxes to them so they can build stadiums, light-rail lines, and other useless urban monuments.

A more cogent argument is made by UC Berkeley sustainability professor Maximilian Auffhammer, who argues that “gas is too cheap” because current prices fail to cover all of the external costs of driving. He cites what he calls a “classic paper” that calculates the external costs of driving to be $2.28 per gallon. If that were true, then one approach would be to tax gasoline $2.28 a gallon and use the revenues to pay those external costs.

The only problem is that most of the so-called external costs aren’t external at all but are paid by highway users. The largest share of calculated costs, estimated at $1.05 a gallon, is the cost of congestion. This is really a cost of bad planning, not gasoline. Either way, the cost is almost entirely paid by people in traffic consuming that gasoline.

The next largest cost, at 63 cents a gallon, is the cost of accidents. Again, this is partly a cost of bad planning: remember how fatality rates dropped nearly 20 percent between 2007 and 2009, largely due to the reduction in congestion caused by the recession? This decline could have taken place years before if cities had been serious about relieving congestion rather than ignoring it. In any case, most of the cost of accidents, like the other costs of congestion, are largely internalized by the auto drivers through insurance.

The next-largest cost, pegged at 42 cents per gallon, is “local pollution.” While that is truly an external cost, it is also rapidly declining as shown in figure 1 of the paper. According to EPA data, total vehicle emissions of most pollutants have declined by more than 50 percent since the numbers used in this 2006 report. Thus, the 42 cents per gallon is more like 20 cents per gallon and falling fast.

At 12 cents a gallon, the next-largest cost is “oil dependency,” which the paper defines as exposing “the economy to energy price volatility and price manipulation” that “may compromise national security and foreign policy interests.” That problem, which was questionable in the first place, seems to have gone away thanks to the resurgence of oil production within the United States, which has made other oil producers, such as Saudi Arabia, more dependent on us than we are on them.

Finally, at a mere 6 cents per gallon, is the cost of greenhouse gas emissions. If you believe this is a cost, it will decline when measured as a cost per mile as cars get more fuel efficient under the current CAFE standards. But it should remain fixed as a cost per gallon as burning a gallon of gasoline will always produce a fixed amount of greenhouse gases.

In short, rather than $2.38 per gallon, the external cost of driving is closer to around 26 cents per gallon. Twenty cents of this cost is steadily declining as cars get cleaner and all of it is declining when measured per mile as cars get more fuel-efficient.

It’s worth noting that, though we are seeing an increase in driving due to low fuel prices, the amount of driving we do isn’t all that sensitive to fuel prices. Real gasoline prices doubled between 2000 and 2009, yet per capita driving continued to grow until the recession began. Prices have fallen by 50 percent in the last six months or so, yet the 3 or 4 percent increase in driving may be as much due to increased employment as to more affordable fuel.

This means that, though there may be some externalities from driving, raising gas taxes and creating government slush funds with the revenues is not the best way of dealing with those externalities. I’d feel differently if I felt any assurance that government would use those revenues to actually fix the externalities, but that seems unlikely. I actually like the idea of tradable permits best, but short of that the current system of ever-tightening pollution controls seems to be working well at little cost to consumers and without threatening the economic benefits of increased mobility.

O’Toole’s latest book is American Nightmare: How Government Undermines The Dream of Homeownership. O’Toole is the author of numerous Cato papers. He has also written for Regulation magazine as well as op-eds and articles for numerous other national journals and newspapers. O’Toole travels extensively and has spoken about free-market environmental issues in dozens of cities. The app economy has improved our lives in thousands of small ways, with seemingly endless opportunities to download and use gadgets that help us throughout the day, whatever our needs. Most are free or purchasable at a nominal charge.

Forget the ingredients for Shepherd’s Pie? Find it in seconds on the smartphone. Worried about the side effects of a new drug? They are there for you. Not sure about the quality of the restaurant you are about to enter? The crowds are anxious to tell you. Need a burrito for lunch? Uber will bring you one. (You can get a flu shot and a kitty, too.)

The truth is that we live completely different lives than we did ten years ago. We have unprecedented access to all life’s necessities, including medical and nutrition information, mapping information, the weather anywhere, plus hundreds of communication apps that allow text, audio, and video with half the human race, instantly, at no charge.

New Waze of Driving
The app I’m most excited about today is a navigation tool called Waze. It provides mapping, plus delightful instructions on how to get from here to there. But beyond that, it crowdsources information to make the trip more efficient and safer than it otherwise would be. In big cities, Waze will take you through circuitous routes to avoid high traffic areas. It alerts you to accidents, road blocks, and debris on the road.

Impressively, it allows drivers to report where the police are staking out speed traps. It tells you whether the officer in question is visible or hidden. You can also confirm or deny the report.

Police have objected to this feature of the app. Why? Because it means that drivers are better able to avoid getting ticketed. But think about this: the app actually succeeds in causing people to obey the law better by slowing down and being safer, as a way of avoiding fines.

Why would police object? If the whole point of traffic police is to get people to drive more safely, knowing about police presence achieves that goal.

Of course, we all know the real reason. The goal of the police on roads is not to inspire better driving but rather catch people in acts of lawbreaking so that they can collect revenue that funds their department. In other words, the incentives of the police are exactly the opposite of the promised results. Instead of seeking good driving, they are seeking lawbreaking as a means of achieving a different outcome: maximum revenue collection.

The whole ethos of Waze is different. It helps you become aware of your external surroundings, and conscious that other drivers are in a similar situation as you are, just trying to get to their destinations quickly and safely. We are there are help each other.

The Community Matters
For me this effected a big change in the whole way I drive. There is a tendency from your first years of driving to treat other drivers as obstacles. Your goal is to outsmart others who are crowding the road, moving around them quickly and navigating the roads with a chip on your shoulder. If there are no cops around, you drive as fast as possible.

I never intended to drive this way, but now I know that I have been, since I first received my government permission slip to drive. Once behind the wheel, I tended to think of myself as a lone actor.

Waze has subtly changed my outlook on driving. Other drivers become your benefactors because it is they who are reporting on traffic accidents, cars on the side the road, blocked streets, and the presence of police. They are all doing you favors. If you report, others thank you for doing so. You even see icons of evidence that your friends are driving, too.

Safety is priority one. Waze won’t let you type in a new address while you are driving. You have to stop the car before you can do that.

The app manages to create a sense of community out of drivers on the road, and that changes the way you think when you drive. Now I leave Waze on even when I already know the directions. It’s my connection to the community. I find my whole outlook on driving has changed. For the first time in my life, I can honestly say that I’m a safer and more responsible driver.

So thank you Waze — a product of brilliant entrepreneurship, distributed on private networks, performing a public service.

Compare with the people who are charged with the task of making our roads safe and are paid by our tax dollars to do it. Not only do they fail to accomplish what this one free application has done, they are actively seeking to cripple it.

Baby Steps to a Better World
Maybe this seems like too small a life improvement to justify mentioning? Not so. All great steps toward a better world occur at the margin, bit by bit, through trial and error, one innovation at a time. You look back at the progress of a decade and that’s where the awe comes into play.

It is not through large bills written by legislators and signed by presidents that the world improves. It is through small innovations, inauspicious downloads, incremental improvements in our existing paths that gradually build a better world. Waze is only one of a billion but it points to the right method and approach to an improved life.

A just-released poll of Los Angeles residents found that 55 percent of respondents indicated their greatest concern was “traffic and congestion,” far ahead of “personal safety” — the next highest area of concern — at 35 percent. So if their city government was working in their best interests, it would be doing something about automobile congestion.

It is. Unfortunately, it will make things worse.

Los Angeles’s recently adopted Mobility Plan 2035 would replace auto lanes in America’s congestion capital with bus and protected bike lanes, as well as pedestrian enhancements, despite heightening congestion for the vast majority who will continue to drive. Even the City’s Environmental Impact Report admitted “unavoidable significant adverse impacts” on congestion, doubling the number of heavily congested (graded F) intersections to 36 percent during evening rush hours.

Driving Saves Time and Offers More Opportunity

Such an effort to ration driving by worsening gridlock purgatory begs asking a central, but largely ignored, question. Why do planners’ attempts to force residents into walking, cycling, and mass transit — supposedly improving their quality of life — attract so few away from driving?

The reason it takes a coercive crowbar to get most people out of their cars is that automobile users have concluded cars are vastly superior to the alternatives.

Why is automobile use so desirable:

  • Automobiles have far greater and more flexible passenger — and cargo-carrying capacities.
  • They allow direct, point-to-point service.
  • They allow self-scheduling rather than requiring advance planning.
  • They save time.
  • They have far better multi-stop trip capability (this is why restrictions on auto use punish working mothers most).
  • They offer a safer, more comfortable, more controllable environment, from the seats to the temperature to the music to the company.

Those massive advantages explain why even substantial new restrictions on automobiles or improvements in alternatives leave driving the dominant choice. However, they also reveal that a policy that will punish the vast majority who will continue to drive cannot serve residents effectively.

How Restrictions on Automobiles Punish the Working Poor the Most

The superiority of automobiles doesn’t stop at the obvious, either. They expand workers’ access to jobs, increasing productivity and incomes, improve purchasing choices, lower consumer prices and widen social options. Reducing roads’ car-carrying capacity undermines those major benefits.

Cars offer a decrease in commuting times (if not hamstrung by city-government planning), providing workers access to many more potential employers and job markets. This improves worker-employer matches, with expanded productivity both benefiting employers and raising workers’ incomes.

One study found that a 10-percent improvement in travel time raised worker productivity 3 percent. And increasing from a 3 mph walking speed to 30 mph driving speed is a 900-percent increase. In a similar vein, a Harvard analysis found that for those lacking high-school diplomas, owning a car increased monthly earnings by $1,100.

Cars are also the only means of assembling enough customers to sustain large stores with highly diverse offerings. Similarly, “automobility” dramatically expands the menu of social opportunities that are accessible.

Supporters like Los Angeles Mayor Eric Garcetti may dismiss the serious adverse effects of the “road diets” they propose (a term whose negative implications were too obvious, getting it benched in favor of the better-sounding “complete streets”). But by demeaning cars as “the old model” and insisting “we have to have neighborhoods that are more self-contained,” the opponents of auto use do nothing to lessen the huge costs or increase the very limited benefits they plan to impose on those they supposedly represent.

Further, the “new model” of curtailing road capacity to force people out of cars is really a recycled old far-inferior model. As urban policy expert Randal O’Toole noted in The Best-Laid Plans:

Anyone who prefers not to drive can find neighborhood … where they can walk to stores that offer a limited selection of high-priced goods, enjoy limited recreation and social opportunities, and take slow public transit vehicles to some but not all regional employment centers, the same as many Americans did in 1920. But the automobile provides people with far more benefits and opportunities than they could ever have without it.

A major benefit of longer lifespans is the cultivation of a wide array of virtues. Prudence and forethought are among the salutary attributes that the lengthening of human life expectancies – hopefully to the point of eliminating any fixed upper bound – would bring about.

Living longer renders people more hesitant to risk their lives, for the simple reason that they have many more years to lose than their less technologically endowed ancestors.

This is not science fiction or mere speculation; we see it already. In the Western world, average life expectancies increased from the twenties and thirties in the Middle Ages to the early thirties circa 1800 to the late forties circa 1900 to the late seventies and early eighties in our time. As Steven Pinker writes in his magnum opus, The Better Angels of Our Nature, the overall trend in the Western world (in spite of temporary spikes of conflict, such as the World Wars) has been toward greater peace and increased reluctance of individuals to throw their lives away in armed struggles for geopolitical gain. Long-term declines in crime rates, automobile fatalities, and even smoking have accompanied (and contributed to) rises in life expectancy. Economic growth and improvements in the technologies of production help as well. If a person has not only life but material comfort to lose, this amplifies the reluctance to undertake physical risks even further.

Yet, with today’s finite lifespans, most individuals still find a non-negligible degree of life-threatening risk in their day-to-day endeavors to be an unavoidable necessity. Most people in the United States need to drive automobiles to get to work – in spite of the risk of sharing the road with incompetent, intoxicated, or intimidating other drivers. Over 30,000 people perish every year in the United States alone as a result of that decision. While the probability for any given individual of dying in an automobile accident is around 11 in 100,000 (0.011%) per year, this is still unacceptably high. How would a person with several centuries, several millennia, or all time ahead of him feel about this probability? Over a very long time, the probability of not encountering such a relatively rare event asymptotically approaches zero. For instance, at today’s rate of US automobile fatalities, a person living 10000 years would have a probability of (1 – 0.00011)^10000 = 0.3329 – a mere 33.29% likelihood – of not dying in an automobile accident! If you knew that a problem in this world had a two-thirds probability of killing you eventually, would you not want to do something about it?

Of course, the probabilities of tragic events are not fixed or immutable. They can be greatly affected by individual choices – our first line of defense against life-threatening risks. Well-known risk-management strategies for reducing the likelihood of any damaging event include (1) avoidance (not pursuing the activity that could cause the loss – e.g., not driving on a rugged mountain road – but this is not an option in many cases), (2) loss prevention (undertaking measures, such as driving defensively, that allow one to engage in the activity while lowering the likelihood of catastrophic failure), and (3) loss reduction (undertaking measures, such as wearing seat belts or driving in safer vehicles, that would lower the amount of harm in the event of a damaging incident). Individual choices, of course, cannot prevent all harms. The more fundamental defense against life-threatening accidents is technology. Driving itself could be made safer by replacing human operators, whose poor decisions cause over 90% of all accidents, with autonomous vehicles – early versions of which are currently being tested by multiple companies worldwide and have not caused a single accident to date when not manually driven.

Today, forward-thinking technology companies such as Google are driving the autonomous-vehicle revolution ahead. There is, unfortunately, no large clamor by the public for these life-saving cars yet. However, as life expectancies lengthen, that clamor will surely be heard. When we live for centuries and then for millennia, we will view as barbarous the age when people were expected to take frightening risks with their irreplaceable existences, just to make it to the office every morning. We will see the attempt to manually operate a vehicle as a foolish and reckless gamble with one’s life – unless one is a professional stunt driver who would earn millions in whatever future currency will then exist.

But living longer will accomplish more than just a changed perspective toward the risks presently within our awareness. Because of our expanded scope of personal interest, we will begin to be increasingly aware of catastrophes that occur at much longer intervals than human lifespans have occupied to date. The impacts of major earthquakes and volcano eruptions, recurring ice ages, meteor strikes, and continental drift will begin to become everyday concerns, with far more individuals devoting their time, money, and attention to developing technological solutions to these hitherto larger-than-human-scale catastrophes. With even more radically lengthened lifespans, humans will be motivated to direct their efforts, including the full thrust of scientific research, toward overcoming the demise of entire solar systems. In the meantime, there would be less tolerance for any pollution that could undermine life expectancies or the long-term sustainability of a technological infrastructure (which, of course, would be necessary for life-extension treatments to continue keeping senescence at bay). Thus, a society of radical life extension will embrace market-generated environmentally friendly technologies, including cleaner energy sources, reuse of raw materials (for instance, as base matter for 3D printing and nanoscale fabrication), and efficient targeting of resources toward their intended purposes (e.g., avoidance of wasted water in sprinkler systems or wasted paper in the office).

When life is long and good, humans move up on the hierarchy of needs. Not starving today ceases to be a worry, as does not getting murdered tomorrow. The true creativity of human faculties can then be directed toward addressing the grand, far more interesting and technologically demanding, challenges of our existence on this Earth.

Some might worry that increased aversion to physical risk would dampen human creativity and discourage people from undertaking the kinds of ambitious and audacious projects that are needed for technological breakthroughs to emerge and spread. However, aversion to physical risk does not entail aversion to other kinds of risk – social, economic, or political. Indeed, social rejection or financial ruin are not nearly as damaging to a person with millennia ahead of him as they are to a person with just a few decades of life left. A person who tries to run an innovative business and fails can spend a few decades earning back the capital needed to start again. Today, few entrepreneurs have that second chance. Most do not even have a first chance, as the initial capital needed for a groundbreaking enterprise is often colossal. Promising ideas and a meritorious character do not guarantee one a wealthy birth, and thus even the best innovators must often start with borrowed funds – a situation that gives them little room to explore the possibilities and amplifies their ruin if they fail.  The long-lived entrepreneurs in a world of indefinite life extension would tend to earn their own money upfront and gradually go into business for themselves as they obtain the personal resources to do so. This kind of steady, sustainable entry into a line of work allows for a multitude of iterations and experiments that maximize the probability of a breakthrough.

Alongside the direct benefits of living longer and the indirect benefits of the virtues cultivated thereby, indefinite life extension will also produce less stressful lives for most. The less probability there is of dying or becoming seriously injured or ill, the easier one can breathe as one pursues day-to-day endeavors of self-improvement, enjoyment, and productive work. The less likely a failure is to rob one of opportunities forever, the more likely humans will be to pursue the method of iterative learning and to discover new insights and improved techniques through a beneficent trial-and-error process, whose worst downsides will have been curtailed through technology and ethics. Life extension will lead us to avoid and eliminate the risks that should not exist, while enabling us to safely pursue the risks that could benefit us if approached properly.
