{"id":5526,"date":"2016-01-04T22:33:53","date_gmt":"2016-01-04T22:33:53","guid":{"rendered":"http:\/\/www.rationalargumentator.com\/index\/?p=5526"},"modified":"2016-01-04T22:42:51","modified_gmt":"2016-01-04T22:42:51","slug":"result-act-bill","status":"publish","type":"post","link":"https:\/\/www.rationalargumentator.com\/index\/blog\/2016\/01\/result-act-bill\/","title":{"rendered":"One Bill Could Massively Improve Access to Lifesaving Drugs &#8211; Article by Alex Tabarrok"},"content":{"rendered":"<div>\n<div style=\"text-align: center\"><a class=\"cboxElement\" href=\"https:\/\/www.rationalargumentator.com\/index\/wp-content\/uploads\/2015\/06\/tophatwhitesm.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-4311 aligncenter\" src=\"https:\/\/www.rationalargumentator.com\/index\/wp-content\/uploads\/2015\/06\/tophatwhitesm.jpg\" alt=\"The New Renaissance Hat\" width=\"150\" height=\"150\" srcset=\"https:\/\/www.rationalargumentator.com\/index\/wp-content\/uploads\/2015\/06\/tophatwhitesm.jpg 150w, https:\/\/www.rationalargumentator.com\/index\/wp-content\/uploads\/2015\/06\/tophatwhitesm-100x100.jpg 100w\" sizes=\"auto, (max-width: 150px) 100vw, 150px\" \/><\/a><strong><big><big><span style=\"color: #000080\">Alex Tabarrok<\/span><br \/>\n<\/big><\/big><\/strong><\/div>\n<\/div>\n<div style=\"text-align: center\">******************************<\/div>\n<div style=\"text-align: center\"><\/div>\n<div>\n<div class=\"clear-this mainContent\">\n<p style=\"text-align: center\"><strong><em>Reciprocity is an effective and common-sense idea<br \/>\n<\/em><\/strong><\/p>\n<p>Senators Ted Cruz (R-Texas) and Mike Lee (R-Utah) have just introduced a bill that would implement an idea that I have long championed:\u00a0making drugs, devices, and biologics that are approved in other developed countries also\u00a0approved for sale in the United States.<\/p>\n<p><a href=\"http:\/\/www.cruz.senate.gov\/?p=press_release&amp;id=2554\">Highlights<\/a> of the \u201cReciprocity Ensures Streamlined Use of Lifesaving Treatments Act (S. 2388), or the <a href=\"http:\/\/www.cruz.senate.gov\/files\/documents\/Bills\/20151211_FDA.pdf\">RESULT Act<\/a>,\u201d include:<\/p>\n<ul>\n<li>Amending the Food, Drug and Cosmetic Act to allow for reciprocal approval of drugs, devices and biologics from foreign sponsors in certain trusted, developed countries including EU member countries, Israel, Australia, Canada and Japan.<\/li>\n<li>Encouraging the FDA to expeditiously review life-saving drug and device applications, this legislation would provide the FDA with a 30-day window to approve or deny a sponsor\u2019s application\u2026.<\/li>\n<li>The HHS Secretary is instructed to approve a drug, device or biologic if the FDA confirms the product is:\n<ul>\n<li>Lawfully approved for sale in one of the listed countries;<\/li>\n<li>Not a banned device by current FDA standards;<\/li>\n<li>There is a public health or unmet medical need for the product.<\/li>\n<\/ul>\n<\/li>\n<li>If a promising application for a life-saving drug is declined Congress is granted the authority to disapprove of a denied application and override an FDA decision with a majority vote via a joint resolution.<\/li>\n<\/ul>\n<p>In explaining why he introduced the bill, Senator Cruz <a href=\"http:\/\/www.nationalreview.com\/article\/425934\/FDA-drug-approval-bottleneck\">argued<\/a>:<\/p>\n<blockquote><p>We continue to lose far too many of our loved ones to the \u201cinvisible graveyard,\u201d as economist Alex Tabarrok has described: lives that could have been saved but for a bureaucratic barrier that rejects medical cures and innovation\u2026<\/p>\n<p>The bill I am introducing takes the first step to reverse this trend.
