Why Free Speech on Campus Is Under Attack: Blame Marcuse – Article by Jeffrey A. Tucker

It’s become routine. An outside lecturer like Charles Murray or FEE’s own Lawrence Reed is invited to lecture on campus, just to give a different perspective than students might be hearing in the classroom. It seems like the way academia is supposed to work: many ideas are presented as a contribution to a rich education and the student is given the tools to make up his or her own mind.

But instead of a fair hearing, the invited lecturer is met with protests and gets shouted down. Aggressive and belligerent students accuse the speaker of every manner of evil. It’s not even about providing an intellectual challenge. No one minds that. The protesters want to stop the speaker from saying anything. They intimidate, threaten, scream, shout, and drive the guest from campus. The victors claim that the campus has been made safe again.

Outsiders look at the attacks on visiting lecturers on campus and wonder why. What could be the harm in hearing an alternative point of view? Isn’t that the point of a university, and a higher education generally? Aren’t students supposed to be trusted with discernment enough to be exposed to a broad range of ideas?

None of it makes much sense, unless you understand a bizarre ideology that has exercised a massive influence in academia since the rise of the New Left in the late 1960s. In the old days, people associated the Left with an ethos akin to the ACLU today: the right to speak, publish, and associate. The turn that took place with the New Left actually flipped whatever remaining attachment that the Left had with freedom.

Blinded by Ideology

There was one major influence here: Herbert Marcuse, the father of the New Left and perhaps the most influential Marxist of the last half century, and his most famous essay from 1965: Repressive Toleration. It is here that you find the template for an upside-down view of freedom held by so many students today. In this essay, Marcuse explains that free speech and toleration are illusions so long as society has yet to conform to the Marxian ideal. So long as that is true, in fact, free speech must be suppressed and toleration itself must not be tolerated.

In some ways, this essay is a blueprint not only for an oppressive campus life dominated by left-wing hegemony; it also offers a rationale for the totalitarian state itself. But in order to understand where he is coming from, and why those under his influence can be so controlling and even terrifying toward basic standards of civility, you need to know the background of his thought.

Marcuse was born in 1898, one year before F.A. Hayek, whose life and ideas serve as a foil for the Frankfurt School that Marcuse represented. And like Mises, Marcuse was driven out of of his home by the Nazis and spent time in Geneva before coming to the United States as an emigre. Unlike Hayek and Mises, Marcuse was a dedicated Marxist, and a main influence in the extension of Marxist economic theory to cover a broader range of philosophical topics.

Both Marx and Marcuse were successors in the long tradition of left-Hegelian thought that opposed every aspect of the rise of laissez-faire commercial life in the 19th century. The Hegelian view was that what we call freedom for average people was a social mask for a meta-narrative of history that was grim and dreadful. Impersonal forces in history were at work creating struggles, clashes, and wars between large-scale social aggregates. The free market (and freedom generally) might look like harmony but it is an illusion to cover a terrible exploitation that the workers and peasants might not directly perceive but could be discerned by enlightened intellectuals.

The goal of history, in this view, is to realize some grand conclusive stage in which the social order ceases to be a messy place of marginal improvements in living standards and instead resembles some utopia as defined by intellectuals. The trick for this point of view is finding the necessary path from here to there.

Recall the strange way in which Marx’s view that the state must “wither away” became an ideological cover for the realization of the total state itself. It’s all about the transition. Yes, Marx said, the state will go away forever, but only once the new socialist man had been created and the reactionary forces keeping scientific socialism at bay were entirely expropriated (or exterminated).

Suppress Freedom to Gain It

As a dedicated Marxist (and left-Hegelian generally), Marcuse believed that the same was true for other bourgeois institutions like free speech, free press, and toleration. Yes, he shared the goal that we need all those things. “Tolerance is an end in itself,” he says with some promise that he could make some sense. “The elimination of violence, and the reduction of suppression to the extent required for protecting man and animals from cruelty and aggression are preconditions for the creation of a humane society.”

Right on! And yet, he says, “Such a society does not yet exist; progress toward it is perhaps more than before arrested by violence and suppression on a global scale.” Every exercise of freedom as it exists is loaded and dominated by existing elites, who skew the debate to favor their position. It’s not a level playing field because social inequities are so prevalent as to be decisive in all outcomes.

As with Marx, in other words, we’ve got a problem in the transition. The masses of people are being deluded by anti-Marxian practices by governments and power elites, practices which have unleashed every manner of horror: neo-colonial massacres, violence and suppression, racist exploitation, police state oppression, and the domination of society by forces of power.

You know the litany of evils, of course. But the more you read, the more you realize that the real problem according to Marcuse comes down to one word: capitalism. So long as that survives, the masses will be lacking in proper discernment to see and know what is true. In this case, toleration will only provide opportunities for the perpetuation of evil. “Tolerance is extended to policies, conditions, and modes of behavior which should not be tolerated because they are impeding, if not destroying, the chances of creating an existence without fear and misery.”

If we allow free speech and give a platform to non-Marxist ideas, the great Hegelian moment when we reach the end of history will continue to elude us.

For this reason, we need to adopt full-scale repression – at least until the end of history arrives. As Marcuse wrote:

They would include the withdrawal of toleration of speech and assembly from groups and movements which promote aggressive policies, armament, chauvinism, discrimination on the grounds of race and religion, or which oppose the extension of public services, social security, medical care, etc. Moreover, the restoration of freedom of thought may necessitate new and rigid restrictions on teachings and practices in the educational institutions which, by their very methods and concepts, serve to enclose the mind within the established universe of discourse and behavior – thereby precluding a priori a rational evaluation of the alternatives.

And to the degree to which freedom of thought involves the struggle against inhumanity, restoration of such freedom would also imply intolerance toward scientific research in the interest of deadly ‘deterrents’, of abnormal human endurance under inhuman conditions, etc.

Wait just a minute here. Did you catch that? Marcuse says that if you oppose policies like social security or Obamacare, you should be denied the freedom of speech and assembly. You should be shut up and beat up. The path toward true freedom is through massive real-world oppression. If you have the wrong views, you have no rights.

The entire essay is born of frustration that the Marxists have not yet won, that they continue to have to make a case for their perspective in the face of tremendous opposition. Given that he and his friends are part of a priesthood of truth, shouldn’t they just be declared the winners and contrary views suppressed?

In other words, it is possible to define the direction in which prevailing institutions, policies, opinions would have to be changed in order to improve the chance of a peace which is not identical with cold war and a little hot war, and a satisfaction of needs which does not feed on poverty, oppression, and exploitation. Consequently, it is also possible to identify policies, opinions, movements which would promote this chance, and those which would do the opposite. Suppression of the regressive ones is a prerequisite for the strengthening of the progressive ones.

What about freedom and stuff? We’ll get there, but first all opponents of how Marcuse defined freedom must be eliminated. In other words, this is not real freedom. It is a big excuse for suppression, despotism, and the total state.

Or as Marcuse said with characteristic bluntness, we must push the “cancellation of the liberal creed of free and equal discussion.” We must, he said, be “militantly intolerant.”

Who Rules?

Now, the question is: who should be in charge of deciding “the distinction between liberating and repressive, human and inhuman teachings and practices.” The answer is readily at hand: properly enlightened intellectuals like Marcuse and his friends, who must be put in charge of the regime managing the transition. As he puts it, a decider should be “in the maturity of his faculties as a human being.”

It is they who should speak and be charged with putting down contrary views. To Marcuse, it is no different from how society tries to control juvenile delinquents. They don’t have rights and freedoms. Neither should unenlightened adults persist in the failure to be Marxists like him.

Here we have a classic demonstration of the power of dogma. It can distort the world around you to the point that black becomes white, up is down, and slavery is freedom.

It reminds me of the time that Leon Trotsky visited the New York subway and noticed that there were machines dispensing gum. He concluded that gum was a capitalist plot to keep the jaws of the workers moving so that they would not perceive their status as slaves having their surplus value stolen by capitalist exploiters.

And yet: sometimes gum is just gum.

So you wonder: where are these attacks on free speech coming from? They are coming from the academy where this stuff is taught to students of sociology, politics, and literature, from day one. It doesn’t mean that people are literally reading Marcuse or even that their professors have done so. Philosophy works this way. Bad ideas are like termites: you can’t entirely see them, and suddenly the whole house falls in.

Astute readers will notice a strange parallel between the ideas of Marcuse and those of the alt-right that imagines that violating the rights of people who disagree is the way to make progress toward real freedom. The model for the alt-right is the world of Pinochet: dissidents must be thrown out of helicopters.

Indeed, there is not much substantial difference between the Nazi politics of Carl Schmitt and the Marxist politics of Herbert Marcuse. They both exist within the same Hegelian ideological bubble, operating as mirror images of each other. One gives rise to the other in alternating sequences of action and reaction. Two sides of the same coin.

Each wants to suppress the other, which is why the complaints of alt-rightists are so disingenuous. They complain about having their free-speech rights violated, but they aspire to do exactly the same to their own enemies.

And, incidentally, censorship is like socialism: it works in theory but not in practice. Suppressing ideas subsidizes the demand for the very idea being put down. You can’t control the human mind by controlling speech alone.

What about Real Freedom?

As you read through this material, the question keeps coming back to you. What about actual freedom right now? What about actual speech right now? Not freedom and speech toward a specific goal, a spelled-out end of history scenario, but rather just real freedom and speech, right now. And what about commercial freedom itself, which has done more to improve the lives of regular people more than any imagined end-state of history as cobbled together by intellectual elites.

Exploring this left and right Hegelian literature makes you appreciate the absolute genius of the old liberal creed, and the handful of great intellectuals who upheld it through the 20th century against these dangerous and illiberal ideologies. Only in this literature will you discover the great truth that freedom right now, right where we are in this stage of history, is the only social goal truly worth fighting for.

What do academics do for excitement over the summer, you ask? This summer many of us have been engaged in a furious debate over the new book Democracy in Chains by Duke historian Nancy MacLean.

Libertarian and conservative scholars from a variety of disciplines have raised a number of criticisms about MacLean’s sources and her accuracy about historical facts that call into question the “evidence” she has to show that economist James Buchanan and public choice theory, if not libertarianism more generally, are all tools of racist oligarchs like the Koch Brothers.

Rather than rehash all of the particular criticisms, I want to focus on the controversy that has developed over the criticisms themselves. It’s important to understand that the libertarian critics of MacLean have carefully compared passages in her book with her cited sources and showed how she has misread and quoted selectively from them, often leading her to attribute to people the exact opposite of the argument they actually held. These criticisms have been posted publicly on blogs and websites. These are not just vague accusations. They are detailed examples of poor scholarship.

But the fascinating part has been her response. And her lack thereof.

Everyone Is under Attack

MacLean has offered no substantive response to the detailed criticisms. She had one exchange with Russ Roberts over her treatment of Tyler Cowen, but even there she did not respond to the substance of Russ’s concerns. Other than that, nothing.

What she did do, however, was put up a long Facebook post that reads like a combination conspiracy theory tract and call to action for progressive activists. The short version is that she claimed she was under “attack” from a conspiracy of “Koch operatives” who were paid hacks out to destroy her book and her reputation and silence her. She claimed, then retracted when she found out it couldn’t be done, that the Kochs had bought Google results to put the critics at the top of searches. She encouraged her supporters to game the Amazon reviews by posting positive reviews and down-voting the “fake” Koch reviews.

She has continued this narrative of being “under attack” in various interviews, and most recently in a story in Inside Higher Ed, where fellow progressives echo this language.

This notion of being “attacked” is particularly fascinating to me. Let’s be clear what she means: people who know a lot about Buchanan, public choice theory, and libertarianism have taken issue with her scholarship and have patiently and carefully documented the places where she has made errors of fact or interpretation, or mangled and misused source materials and quotes. That is all that they have done.

None of this was coordinated nor was it part of a conspiracy from the Koch brothers. It was scholars doing what scholars do when they are confronted with bad scholarly work, especially when it touches on issues we know well.

None of these critics, and I am among them, have called for physical violence against her. None have contacted her employer. None have called her publisher or Amazon to have the book taken down. Contrary to her claim, the only silence in this whole episode is her own refusal to respond to legitimate scholarly criticism. We don’t want to silence her – we eagerly await her response.

So where is this language of “attack” coming from? Here is where I think the political right bears some responsibility for the current situation. And to the degree libertarians have cast their lot with “the right,” we are seen as guilty by association. Call it blowback if you will.

In the last year or two, progressive intellectuals and academics have been threatened with violence and had their employers contacted, not to mention threats made from politicians, on the basis of public statements they’ve made. Yes, some of those statements were deplorable, but that is no excuse for threatening people’s physical safety or their jobs. These are real attacks, not intellectual criticisms.

We should also not forget the anti-intellectual “Professor Watch List” put up by TurningPoint USA, which gave left-leaning faculty more reason to imagine coordinated and conspiratorial attacks.

And yes, all of this was not done by conservative or libertarian intellectuals, but they were done by activists associated with “the right,” and that is all that progressives need to find the intellectuals guilty by association.

It probably also matters, though less so, that many conservative and libertarian students have referred to themselves as “under attack” in college classrooms. In my 30 years of teaching experience, what they call “under attack” is far more often than not simply having their views strongly challenged and being expected to defend them. In other words, exactly what MacLean is experiencing.

This is not being “attacked.” It is what college classrooms and scholarly conversation are all about.

Unfortunately, the real attacks on left-wing faculty (and yes, there have been ones on right-wing ones too) have provided MacLean’s defenders with a convenient word to use to blur the difference between legitimate, but forceful, scholarly criticism, and threats of violence or silencing.

Always Take the High Road

Conservative critics of higher education should take this to heart. When you whip people into a frenzy over the crazy things that a small number of faculty say on Twitter, or because of legitimate concerns about the treatment of a small number of conservative speakers, the whipped up folks are going to do things you wish they wouldn’t. And that’s going to lead to blowback.

As a libertarian academic who frequently speaks at public events on other campuses, I do have low-level concerns about my safety. And if I were a progressive academic, I’d have similar fears given the way some of them have been treated, especially by politicians. Calling the intellectual criticisms of her book a coordinated conspiracy heads MacLean into Alex Jones territory, but given the current climate, it shouldn’t surprise us that she and her supporters feel “under attack.”

But notice the result: a book that smears libertarian and conservative ideas on the basis of shoddy scholarship gets attention because the author claims she’s under attack when she is called out in careful detail by other scholars. The real attacks on left-leaning faculty enable her to claim victimhood by association while using guilt by association to blame the conservative and libertarian intellectuals who are criticizing her work.

Once we head down the road, whether caused by the left, right, or libertarians, of turning intellectual disagreements into threats of violence, or threats to employment, or anything of that sort, the social losses are huge. Indeed, once both threats to people’s safety and employment and sharp intellectual disagreement become “attacks,” we will lose our ability to recognize the moral and intellectual difference between the two, and our disgust at the threats will weaken. And to the degree that the left largely dominates the intellectual world, conservatives and libertarians will be the biggest losers when academia turns into Fight Club.

So what to do? First, call off the dogs. Conservatives and libertarians need to consistently take the high road, as many of the intellectuals have tried to do in response to MacLean’s book. The hard part is getting right-wing media, both traditional and social media, to do the same. Those of us who care about intellectual standards have to publicly call out our own when they whip up anti-intellectual and anti-higher education frenzies.

Second, implore our left-wing friends of integrity to do the same. The most important thing that can happen to end this arms race is for scholars of integrity on the left to call out people like MacLean, both for their shoddy scholarship and their hyperbolic use of the language of conspiracy and attack. A strongly critical review of her book by a historian or economist of the center or left would go a long way to addressing the specific concerns it raises and could set a necessary example for others.

In the meantime, those of us critical of MacLean will continue to document her errors and press publicly for a response. And we’ll do so with the most proper of scholarly etiquette. I implore those sympathetic to our cause to be on their best behavior on social media as well. She and her supporters need no more ammunition.

I’ve never been able to get into the Halloween spirit. Maybe that’s because most of my childhood’s trick-or-treating consisted of candy corn. But as I’ve grown, I’ve gained a new appreciation for this holiday. It’s an exhibition and embrace of cultural diversity through costumes and tog.

Honoring the Other  

When I see a beautiful Caucasian woman dressing up as a Salsa Dancer, or a group of Asian college students dressed as the Jackson Five, it resonates with me in a very positive way. The Salsa Dancer dressed as such because she sees the beauty of the culture, attire, and people that are associated. She adores this culture so much that she’s willing to spend her own money to embody it for a single night. The Asian kids dressing up as the Jackson Five clearly have not only knowledge of the legendary African-American pop sensation, but have also been impacted by the cultural talents they delivered to the market.

This is why I see Cultural Appropriation as a gesture of love within humanity. It’s a refreshing deviation from conventional US ethnocentric patriotism and isolation. I’m thrilled to see people dressing up as diverse identities from around the globe, and not just wearing American Flag trucker hats and Confederate bikinis.

As our culture becomes more and more politically correct and censorious of “offensive” displays of cultural mimicry, diversity has become less about expressions of humanistic cooperation, and more about competitive oppression.

In PC parlance, that Salsa Dancer costume is actually insensitive to the economic suffering of Hispanic women who had to subject themselves to patriarchal theater. That Jackson Five getup ignores the capitalist exploitation by the music industry of black artists during the American Civil Rights movement. This is the narrative you will commonly hear pushed on many progressive university campuses and blog sites.

Some find this to be annoying, but I’d actually go as far as to call it outright insulting and abusive. Who are you to tell someone that they aren’t allowed to express their love for another culture because you arbitrarily hold exclusive claim to it? Who are you to micromanage identity and dictate what types of multiculturalism is tolerable and intolerable?

In the attempt made by progressives to socially abolish what they rule as problematic cultural appropriation, the actual effect is to make harmonious ethnic relations less likely to occur.

That Which Separates Us

Once a white man dressing up as an Arabian Sheik or a black man dressing up as an Irish bagpiper was met with excitement and interest. Now there exists a mob to ridicule them into hiding for being racist bigots. Basically they are saying to these men, “You are different and should stick to your own kind.”

How is that helpful to advancing equality or association? Now these two men are intellectually isolated, likely fostering resentment for diversity. This is dangerous for everyone, especially cultural minorities.

The far left and the Alt-Right have become enablers of each other. While the Alt-Right shames whites for abandoning their heritage and culture and demands that non-whites appropriate European culture, the far left shames whites (primarily) for embracing and adopting cultural differences and contrasts and demands they NOT appropriate.

Neither side wants to break down polarities; neither side wants a free and natural marketplace of voluntary inclusivity and association. I oppose both these factions, which is why I endorse more cultural appropriation not only on Halloween, but every day.

A world without cultural appropriation is a world without learning, emulation, aspiration, celebration, and progress. It is a frozen and dull world of isolation and insularity.

You don’t have to be an assimilative glob of clay to be properly molded by the right or a self-hating ally of the left. Culture is spontaneous, and your expression of it should be as well. So to the white girls, wear box braids if you want. To the black girls, don’t let haters stop you from rocking that blonde relaxer. Dress up as cowboys and Indians, black and white celebrities.

If you’re trans and want to dress as a cis person or visa-versa, do it. Your life is not present to be ordered and manipulated by central planners, governments, fascists, or social justice warriors. Your life is present to pursue your own self-interests and to find what makes you happy. Accusations of degeneracy or racism be damned.

The Department of Justice has sent a letter to UC Berkeley threatening a lawsuit unless the university modifies all of its free online educational materials to meet conditions of accessibility. In response the Vice Chancellor for Undergraduate Education writes:

…we have attempted to maximize the accessibility of free, online content that we have made available to the public. Nevertheless, the Department of Justice has recently asserted that the University is in violation of the Americans with Disabilities Act because, in its view, not all of the free course and lecture content UC Berkeley makes available on certain online platforms is fully accessible to individuals with hearing, visual or manual disabilities.

…We look forward to continued dialog with the Department of Justice regarding the requirements of the ADA and options for compliance. Yet we do so with the realization that, due to our current financial constraints, we might not be able to continue to provide free public content under the conditions laid out by the Department of Justice to the extent we have in the past.

In many cases the requirements proposed by the department would require the university to implement extremely expensive measures to continue to make these resources available to the public for free. We believe that in a time of substantial budget deficits and shrinking state financial support, our first obligation is to use our limited resources to support our enrolled students. Therefore, we must strongly consider the unenviable option of whether to remove content from public access.

In short, the DOJ is saying that unless all have access, none can and UC Berkeley is replying that none will. I sympathize with UC Berkeley’s position. The cost of making materials accessible can be high and the cost is extremely high per disabled student. It would likely be much cheaper to help each disabled student on an individual basis than requiring all the material to be rewritten, re-formatted and reprogrammed (à la one famous example).

An even greater absurdity is that online materials are typically much easier to access than classroom materials even when they do not fully meet accessibility rules. How many teachers, for example, come with captions? (And in multiple languages?) How about volume control? How easy is it for the blind to get to campus? In theory, in-class materials are also subject to the ADA but in practice everyone knows that that is basically unworkable. I guarantee, for example, that professors throughout the UC-system routinely show videos or use powerpoints that do not meet accessibility guidelines. Thus, by raising the costs of online education, the most accessible educational format, the ADA may have the unintended consequence of slowing access. Put simply, raising the costs of online education makes it more difficult for anyone to access educational materials including the disabled.

Free Speech Is about the Power to Challenge the Status Quo

Free speech is the great equalizer in our society. It doesn’t matter about your race, ethnicity, sex, gender identity, gender expression, sexual orientation, class — you get the point — the First Amendment protects your right to speak freely. Despite this, some student activists — perceiving unequal social conditions, including at institutions of higher education — are fighting for social change at the expense of free speech. The sad irony, however, is that free speech only becomes privileged when it’s restricted, which is why free speech must remain a right equally applicable to all.To understand why, consider Nigerian author Chimamanda Ngozi Adichie’s commencement speech at Wellesley College in 2015. In it, she said, “You, because of your beautiful Wellesley degree, have become privileged, no matter your background.” But, she added, “Sometimes you will need to push [this privilege] aside in order to see clearly,” because “privilege blinds” you to those who are different.

Students calling for speech restrictions are particularly blinded by their privilege, which leaves them unable to see the unjust privilege that restricting speech would further confer upon them. This is dangerous and counterproductive to their cause.

Restricting Speech Is an Unjust Privilege
First, to support restrictions on certain kinds of speech, activists must have (or at least project) unwavering confidence in both themselves and the system in which they are operating — the university in this case — to discern what’s offensive. Even if they see gray areas in expression, they are forced to present issues in absolutist terms if they are to have the perceived moral authority to police and punish those who offend.

Turning again to Adichie’s speech, we can see why this is wrong. As she said, “I knew from … the class privilege I had of growing up in an educated family, that it sometimes blinded me, that I was not always as alert to the nuances of people who were different from me.”

Sometimes, people are genuinely racist (though what’s considered racist varies widely from place to place) and their speech is identifiable as such. But what about the student who isn’t aware of the offense he or she may cause by wearing a sombrero at a party, which some consider cultural appropriation? How about the student who is aware but disagrees that it’s offensive? Should he or she be censored and punished based upon some activists’ standards of right and wrong? Different people have different experiences and different views. Because of this, nuance matters.

Second, while it can be tempting to argue that free speech maintains inequality because it protects offensive speech, this argument fails to distinguish between people and their views. That is, when you censor people — even for offensive speech — you are denying them equal access to, and protection of, the First Amendment and you are doing so from a position of privilege.  The right to free speech gives everyone an equal right to voice his or her opinions — but it does not mean that such opinions will win or even register in any given forum.

Restrictions on free speech, on the other hand, make both people and ideas unequal by subjugating them to someone else’s understanding of what’s right and therefore allowable. Indeed, to assume one’s views are so infallible as to warrant imposition on others and to assume there is no legitimate debate left to be had on certain topics — and the language used in discussing those topics — is a privilege that oppresses not only the hated racist, but the honest dissenter and everyone in between.

Lastly, some students claim that free speech is about power — that it enables and sustains privilege for some but not all. Let’s be clear: free speech is about power. It’s about having the power to challenge the status quo, question society’s deeply held beliefs, and call others to task. But free speech only becomes privileged when it’s restricted.

Understanding the Would-Be Censors
Of course words can have consequences. (If they couldn’t, nobody would bother speaking.) It would be hypocritical to argue that offensive speech will never cause harm, at least to feelings or interests, while also maintaining that speech is so vital it requires robust protection. One could also argue that the marketplace of ideas — like all markets — has negative externalities. The most evident, as campus activists assert, is that offensive speech is protected and those it’s directed at — typically thought to be minorities — are disproportionately burdened by it.

Moreover, restricting or punishing speech provides instant gratification. It’s an immediate and swift response to views one finds abhorrent. It gives the impression that justice has been served. For those who believe society is stacked against them, it’s a small beacon of hope. Restricting speech, then, isn’t seen as infringing upon someone else’s liberty, but rather righting a wrong. The emotional appeal is understandably strong.

But this is not right.

A Just Alternative
The best way to counter hateful, offensive speech is with more speech. Think of it this way: restricting speech treats the symptoms of bigotry by making its manifestations less visible. Conversely, more speech acts as a cure by attacking the underlying disease. The former method may seem effective in the short term, but it’s dangerous in the long run.

As FIRE President and CEO Greg Lukianoff has argued, when offensive speech is banned, it drives those with potentially dangerous views (however determined) underground, making them harder to identify, while also potentially making them more extreme. It also gives a false sense of social progress. And who ultimately pays the price? The people the bans were meant to help, when it turns out society wasn’t as friendly as they believed.

Countering hateful speech with more speech is not seamless. It’s hard work, and it’s not instant. It doesn’t guarantee the flushing of all bigoted and hateful opinions from society, and it often works slowly. Nevertheless, it is the only method that is both just and that makes progress last. Engaging with people who express views different from one’s own moves beyond the superficial to challenge core beliefs, assumptions, and biases — and can help a person identify and recognize his or her own. Consider the case of Megan and Grace Phelps, granddaughters of the pastor who founded the Westboro Baptist Church. After interacting with a Jewish man by email and on Twitter, the sisters decided their views were wrong and decided to leave the WBC, which also meant being excommunicated by their family.

The marketplace of ideas won’t always work this way, and not everyone is destined to see the light. But restricting speech is a privileged response that neither makes society more equal nor has any tangible benefit other than providing a false sense of justice, which, in the long term, only fuels underlying problems. We cannot afford to be blind to this reality.

None of this should be construed as a plea to accept the status quo or to disengage. Rather, it’s a call for college students who support restricting speech to recognize their own privilege. Education is a gift, and college students should use the privilege it confers to advocate for change. But this means realizing free speech is not the enemy of progress, and that restricting it will not make society more equal. To do otherwise — to restrict and punish speech — is to be so willfully blind to privilege as to become the oppressors.

Tenure protects the right to be unpopular

Libertarians are understandably frustrated with the state of higher education today. Libertarian ideas often do not get covered, or are covered unfairly. Faculty are overwhelmingly left-of-center, and government subsidies have driven up costs, leading to higher student debt.

These are legitimate concerns of course. However, the solution to these problem is not to abolish the institution of tenure. Tenure is not anti-liberty, and it provides important protections for those who are libertarians (and conservatives) in academia. In addition, it has some efficiency properties that explain why it has survived and might well do so even in a world where the state had no role in higher ed.

There are many potential objections to tenure. For some, the idea that a tenured professor cannot be fired strikes them as a rejection of the free market. Others believe that tenure is a way of protecting leftist faculty, even if their ideas are wrong-headed, and students don’t wish to hear them. In that way, tenure is a kind of monopoly protection for bad ideas. Finally, people across the political spectrum believe that tenure creates so-called “deadwood” faculty who, once they are tenured, no longer have to care about their teaching or research.

First, let’s dispatch a common misconception: it is not true that tenured professors cannot be fired.  Tenured professors can be fired for a variety of reasons.  What tenure does is limit what counts as a valid reason for dismissal in order to protect academic freedom. A tenured professor can be fired if caught plagiarizing, or found guilty of sexual or other forms of harassment, or convicted of violent crime. But if she can be fired for writing an article that the dean disapproves of, she cannot perform her job. And that is where tenure comes in.

Understanding why tenure is a desirable institution requires us to remember the purpose of a university. Universities are, ideally, institutional arrangements that enable scholars to engage in the activities of seeking the truth and then sharing the fruits of our scholarship with students, other scholars, and perhaps the general public.

Essential to that project is that scholars are free to seek the truth as we see it, without interference by others who have different goals. Of course, scholars must play by some very simple rules of the game: do not lie or cheat; do not distort your data or the arguments of your sources; be transparent about conflicts of interest; do not engage in personal attacks or the use of force, among others.

If this sounds familiar, that’s because the search for truth is a discovery process analogous to the market. Just as entrepreneurs in a market require the freedom to discover value where their best judgment takes them, subject to rules against force and fraud, so do scholars in a university require the freedom to discover truth where our best judgment takes us.

Tenure protects scholars like us from interference with our attempts to discover truth. Scholars cannot engage in truth-seeking if we’re facing retaliation from people who don’t like where our research leads. A university cannot be a university without robust protection of the open exchange of ideas and the freedom of each scholar to research in his or her field without intimidation.

By ruling out the possibility of firing a professor simply for the content of her beliefs, tenure ensures that the university will be what Michael Polanyi called “a republic of science,” in which truth-seeking is the highest standard.

Skeptics might argue that even if tenure were abolished, faculty still wouldn’t leave their current jobs because they would find it difficult to get hired elsewhere. But that’s not the point. The point is that we cannot do our jobs without a credible guarantee of academic freedom, and tenure is one way to secure that.

Tenure protects academic freedom in three distinct ways. First, when we engage in research and publishing, we can’t be worried that some administrator, trustee, politician, or even a student activist will find our work offensive and retaliate against us. This will have a chilling effect on our ability to seek the truth, which is our job as college professors. There are numerous examples of libertarian and conservative faculty facing just these sorts of threats, and tenure is the primary reason those threats are empty.

Second, when we construct and teach our curricula, we can’t worry that any of the usual suspects will take offense, or try to substitute their judgment for ours. Finally, when participating in institutional decision making about academic matters, we can’t be afraid to call shenanigans on various administrator-driven fads (of which there are many) that would undermine our ability to engage in research and teaching.

Although we are open to alternative institutional processes if they could be shown to adequately protect academic freedom, abolishing tenure in their absence is a dicey proposition. Absent tenure, it is libertarians and conservatives who would be the first to be persecuted, censored, or silenced.

Politically correct ideas don’t need the protection of tenure because they are popular; tenure protects ideas that are not. Abolishing it would give still more power to the activists and administrators who seek to create an ideologically uniform academy.

Given those concerns, how big is the downside to tenure? If the complaint is that some faculty’s research productivity declines after tenure, then an easy fix is to have continued productivity tied to merit raises.  Nothing about the institution of tenure precludes post-tenure reviews and merit pay. And even if some faculty slack off as publishers, so what? As long as they’re good teachers, mentors, and colleagues, it’s not necessary that all college faculty be active publishers their whole careers.

Tenure offers a beneficial set of incentives for many universities. Faculty want the protections we have outlined above, and universities want to encourage faculty to develop university-specific human capital to better serve their educational vision and the type of students they attract. Faculty don’t necessarily want to make those specific investments if the opportunity cost may be enhancing their publication record so as to make them more attractive in the job market.

Tenure is a commitment by the institution to maintain a faculty member’s employment in return for abiding by some basic rules and demonstrating during the tenure process that they have acquired that institution-specific human capital. The faculty member gets enhanced, but not total, job security, and the institution gets someone committed to its particular needs. In this way, tenure is like marriage: we bind ourselves to an arrangement with high exit costs in order to incentivize ourselves to commit to the relationship. Just as marriage is compatible with a free society, so is tenure.

There are many problems with contemporary higher education, but tenure isn’t one of them. Ending tenure would exacerbate many of those issues while also creating new ones. And in an institutional setting where the opponents of liberty hold most of the cards, getting rid of one of the most important institutions that protects dissent and the ability to seek the truth will only silence the friends of liberty.

Free speech is not something that people would normally see as a realm of economics, but in many ways, an economic understanding of the support and opposition to free speech can shed a lot of light on what’s happening now in the West.

The first thing that needs to be noted is that the left is winning the culture war. Even though more people identify as “conservative” than “liberal” in the United States, more people now identify as “liberal” than in the past by a substantial margin. Attitudes toward gay marriage shifted extremely quickly toward the left while support for legal abortion stayed mostly steady. And obviously the media, academia, and Hollywood are far to the left as a study by the non-partisan political analytics firm Crowdpac found (and as anyone who watches anything other than Fox News can tell after about five minutes).

Now, some of this is certainly good, such as the shifting views on marijuana legalization. Some is troubling, such as the growing popularity of socialism.

Regardless though, the left, having ascended to cultural dominance, is no longer in need of free speech. After all, no one ever got in trouble for agreeing with the conventional wisdom. As Noam Chomsky said, “Even Goebbels was in favor of free speech he liked.”

On the other hand, the right is behind the eight ball in the culture wars and thereby supports the concept of free speech because they need it lest their very opinions be outlawed. In an economic sense, this could be called the “diminishing marginal utility of free speech.”

The law of diminishing marginal utility states that while keeping consumption of other products constant, there is decline in marginal utility that a person derives from consuming an additional unit of that product. In this case, the product is free speech. New leftists may have proposed unfettered free speech back in the early 1960s, but that was just because the right was the one in power culturally at the time. Free speech had a high utility to the left at the time and low utility to the right.

Now the situation has reversed. The right is at the disadvantage so it appeals to free speech. The left is ahead and no longer needs free speech, so it has discarded it.

If that statement sounds hyperbolic, just think of all of the campus speech codes and the ever expanding list of mostly trivial microagressions that can be taken for “hate speech.”  Here is just a small sampling of examples to illustrate how absurd this has become:

  • Brendan Eich was forced to resign as CEO of Mozilla after a massive backlash for having opposed gay marriage.
  • A candidate in the European elections was arrested in Britain for quoting a passage from Winston Churchill about Islam.
  • Gert Wilders, a politician in the Netherlands, was tried on five counts including “criminally insulting Muslims because of their religion.”
  • Conservative radio host Michael Savage was banned from the airwaves in Britain.
  • Both Mark Steyn and Ezra Levant were dragged in front of the Canadian Human Rights Commission on charges of being “Islamophobic.”
  • A man was fired because someone eavesdropped on his joke about dongles and caused a fuss about it on social media.
  • A group called Color of Change applied enough pressure to get Patrick Buchanan fired from MSNBC for expressing politically incorrect opinions in his book Suicide of a Superpower.
  • The “Pickup Artist” Julien Blanc was barred from entering Britain for making sexist comments.
  • A student at Purdue University was found guilty of “racial harassment” for reading (yes, reading) a book called Notre Dame Vs the Klan in which — it should be noted — the Klan is the bad guy.

Indeed, the list goes on endlessly, and is perhaps best summed up by the almost unconscionable lack of self-awareness required by University of Manchester feminists who recently censored the anti-feminist columnist Milo Yiannopoulos from participating in a debate on — you guessed it — censorship.

Of course much of this is just social pressure or the decisions of private institutions, which is permissible (albeit not condoned) under a libertarian framework. But much of it does involve outright government force, or the longing to use it. For example, Adam Weinstein wants to literally “Arrest Climate-Change Deniers.”

Indeed, while many believe that the youth of today are the most politically tolerant in history, they are actually the least. As April Kelly-Woessner notes, “political tolerance is generally defined as the willingness to extend civil liberties and basic democratic rights to members of unpopular groups.” Which groups are unpopular, is not the question being asked.

So, for example, someone who believes that a man should be able to marry his pet goat is not necessarily politically tolerant. What would make him tolerant in this sense is whether he is willing to recognize the rights (particularly regarding speech) of those who disagree with him and his marital proclivities.

In this respect, political tolerance has declined substantially. For the first time since it was measured, the political tolerance of young people has fallen below that of their parents and as Kelly-Woessner again notes, “… is correlated with a ‘social justice’ orientation,” at least for those under forty.

Indeed, the inability to tolerate political views that run counter to one’s own, particularly on the left, has become so ridiculous to be comical. Just take, for example, Judith Shulevtiz’s description of the “safe space” set up at Brown University because of a debate between the feminist Jessica Valentia and Wendy McElroy where McElroy was likely to criticize the term “rape culture.”

The safe space … was intended to give people who might find comments “troubling” or “triggering,” a place to recuperate. The room was equipped with cookies, coloring books, bubbles, Play-Doh, calming music, pillows, blankets and a video of frolicking puppies, as well as students and staff members trained to deal with trauma.

Well, at least they actually let the debate happen.

But the left has not always had a monopoly on anti-free speech thought and legislation. Nor does the right seem to be opposed to it when it can push such things through today. Helen Thomas was fired from the White House Press Corps for saying “The Jews should get the Hell out of Palestine.” Shirley Sherrod was fired for allegedly anti-white statements, a Kansas woman was fired for a fifty-word Facebook post that was considered anti-American-soldier, and the right went into a fervor over Jeremy Wright’s “chickens coming home to roost” comment.

Whereas liberals want to ban words such as “slut” and, at least in Sheryl Sandberg’s case, “bossy” too, conservatives used to all but ban those “seven words you couldn’t say.”

When the right had more cultural authority, alleged communists were being dragged in front of the House Committee on Un-American Activities, Civil Rights activists were harassed, and the Motion Picture Production Code banned Hollywood directors from showing things such as miscegenation.

But that was then and this is now. As the pendulum of cultural prominence swung from one side to the other, the left and right swapped their support for free speech.

Nevertheless, I don’t want to draw a false equivalence here and say the right would be just as bad as the left if they were winning the culture wars. Much of the ideology on the left, at least the far left, is derived from the likes of Herbert Marcuse and other cultural Marxists who explicitly wanted to limit the free speech of “oppressor classes.”

Discerning what exactly free speech is can sometimes be challenging, as in cases of libel, slander, and direct threats. But these are really not the issues at heart here. The vast majority of speech being “regulated” today is simply that of an unpopular opinion. Yes, many ideas are bad. And they should be refuted. Moreover, resorting to the use of political force to silence adversaries is a sign of the weakness of one’s own position. But, in using force to silence others, anti-speech crusaders are making another argument. They’re arguing that political force can and should be used to silence people we don’t like. What idea could be worse than that?

“So, I figured I’d ask you,” said my contractor. “You’re a lot smarter than me and—”

That’s when I stopped him.

Tom knows I am a college professor, and he wanted to ask my advice on his daughter’s education. He’s an ex-Marine who never went to college. It makes sense to ask an educator for advice about education, but why does that make me smarter?

I thought about all the times I’ve asked Tom’s advice about the house we are renovating, and about all the times he answered with a tone that implied, “Well, obviously you should…”

“Tom,” I said, “I wouldn’t say I’m smarter than you. It depends on the topic.”

He smiled politely and moved on to his question.

But even if he dismissed my objection as perfunctory, I can’t let it go. Why does our culture trivialize nonacademic intelligence and knowledge?

I think the existing structure of schooling plays a big part.

Fantasy Football

Let me tell another story, this one from my days as a high school special educator. I was teaching a study-skills class to students with learning disabilities. Partly, this course provided students extra time on assignments for other classes. One day, I sent two students to the library to work on a written project assigned for another course. About 10 minutes later, I received a call from the school librarian.

“You should come up here and get these kids, because they are off task and disturbing others!”

When I got to the library, I didn’t want to confront my students immediately. I wanted to see how, exactly, they were being disruptive.

What were they doing? Adjusting their fantasy football rosters.

As anyone who’s really played fantasy football knows, adjusting your weekly roster involves contemplating a lot of statistics: What are this player’s chances against this team? How does this team do against this type of running back?

That’s what my students were doing in the library: arguing over statistics. Not bad for kids considered learning disabled in subjects like math.

Like a good teacher, I interrupted their passionate dispute and instructed them to come back to the room, where they could get going on the more important work of writing an academic paper.

Whether we mean to or not, we constantly reinforce the message that only the stuff kids are taught in school counts as serious learning. Extracurriculars are fine, but what really counts is in their textbooks and homework.

We send them to school precisely because we believe that’s where they’ll be taught the most important subjects. We grade them on those things, and in many ways we measure their worth (at least while they’re in school) by how well they do on tests and school assignments.

Deschooling America

I’m certainly not the first person to notice this. Education theorist John Holt wrote about it in his frankly titled essay “School Is Bad for Children”:

Oh, we make a lot of nice noises in school about respect for the child and individual differences, and the like. But our acts, as opposed to our talk, says to the child, “Your experience, your concerns, your curiosities, your needs, what you know, what you want, what you wonder about, what you hope for, what you fear, what you like and dislike, what you are good at or not so good at — all this is of not the slightest importance, it counts for nothing.”

Ivan Illich made a similar point in Deschooling Society. Illich suggests that schooling makes us dependent on institutions for learning by convincing us that what we learn in school is important and what we learn outside is not.

Likewise, in Shop Class as Soulcraft, philosopher and auto mechanic Matthew Crawford bemoans the dichotomy we set up in our schools and society between knowing and doing. Schools are increasingly cancelling programs like shop class to make way for more knowing and less doing. Crawford points out that this drastically underestimates the crucial role of thinking in manual labor.

If you are still in doubt, think about this: earlier, I talked about learning disabilities. According to the Diagnostic and Statistical Manual of Mental Disorders (DSM), learning disabilities can only exist in academic subjects like reading and math. If you are bad at playing music or drawing, you are not learning disabled — just bad at music or art.

There may be good reason we leave teaching biology to the schools and teaching how to care of a car to the home (or to “extracurricular” apprenticeships). There may be good reason we teach algebra in the schools but not the statistical analysis needed to adjust a fantasy football roster. But the standard segregation of subjects sends the message that what is learned in school must be more important. We send you to a special building to learn it, we grade you on your ability to learn it, and we socially judge much of your worth by your success at it.

Almost by reflex, we ask kids, “What did you learn in school today?,” not, “What did you learn today?” The existence of school has conditioned us to regard what happens there as important, while we relegate what happens outside of school to the dust heap of “extracurriculars.”

So, no, Tom, I am not smarter than you; we’re both pretty smart. It’s just that our school-influenced culture wrongly tells us that what I do is more cerebral and therefore requires more intelligence than what you do. And that’s a bad assumption.

Last week, former Secretary of Education and US Senator Lamar Alexander wrote in the Wall Street Journal that a college degree is both affordable and an excellent investment. He repeated the usual talking point about how a college degree increases lifetime earnings by a million dollars, “on average.” That part about averages is perhaps the most important part, since all college degrees are certainly not created equal. In fact, once we start to look at the details, we find that a degree may not be the great deal many higher-education boosters seem to think it is.

In my home state of Minnesota, for example, the cost of obtaining a four-year degree at the University of Minnesota for a resident of Minnesota, North Dakota, South Dakota, Manitoba, or Wisconsin is $100,720 (including room and board and miscellaneous fees). For private schools in Minnesota such as St. Olaf, however, the situation is even worse. A four-year degree at this institution will cost $210,920.

This cost compares to an average starting salary for 2014 college graduates of $48,707. However, like GDP numbers this number is misleading because it is an average of all individuals who obtained a four-year degree in any academic field. Regarding the average student loan debt of an individual who graduated in 2013, about 70 percent of these graduates left college with an average student loan debt of $28,400. This entails the average student starting to pay back these loans six months after graduation or upon leaving school without a degree. The reality of this situation is that assuming a student loan interest rate of 6.8 percent and a ten-year repayment period, the average student will be paying $326.83 every month for 120 months or a cumulative total re-payment of $39,219.28. Depending upon a student’s job, this amount can be a substantial monthly financial burden for the average graduate.

All Degrees Are Not of Equal Value

Unfortunately, there is no price incentive for students to choose degrees that are most likely to enable them to pay back loans quickly or easily. In other words, these federal student loans are subsidizing a lack of discrimination in students’ major choice. A person majoring in communications can access the same loans as a student majoring in engineering. Both of these students would also pay the same interest rate, which would not occur in a free market.

In an unhampered market, majors that have a higher probability of default should be required to pay a higher interest rate on money borrowed than majors with a lower probability of default. In summary, it is not just the federal government’s subsidization of student loans that is increasing the cost of college, but the fact that demand for low-paying and high-default majors is increasing, because loans for these majors are supplied at the same price as a major providing high salaries to its possessor with a low probability of default.

And which programs are the most likely to pay off for the student? The top five highest paying bachelor’s degrees include: petroleum engineering, actuarial mathematics, nuclear engineering, chemical engineering and electronics and communications engineering, while the top five lowest paying bachelor’s degrees are: animal science, social work, child development and psychology, theological and ministerial studies, and human development, family studies, and related services. Petroleum engineering has an average starting salary of $93,500 while animal science has an average starting salary of $32,700. This breaks down for a monthly salary for the petroleum engineer of $7,761.67 versus a person working in animal science with a monthly salary of $2,725. Based on the average monthly payment mentioned above, this would equate to a burden of 4.2 percent of monthly income (petroleum engineer) versus a burden of 12 percent of monthly income (animal science). This debt burden is exacerbated by the fact that it is now nearly impossible to have student loan debts wiped away even if one declares bankruptcy.

Ignoring Careers That Don’t Require a Degree

Meanwhile, there are few government loan programs geared toward funding an education in the trades. And yet, for many prospective college students, the trades might be a much more lucrative option. Using the example of plumbing, the average plumber earns $53,820 per year with the employer paying the apprentice a wage and training.

Acknowledging the fact that this average salary is for master plumbers, it still equates to a $20,000 salary difference between it and someone with a four-year degree in animal science while having no student loans as a bonus. Outside of earning a four-year degree in science, technology, engineering, math or, accounting with an average starting salary of $53,300, nursing with an average starting salary of $53,624, or as a family practice doctor on the lower end of physician pay of $161,000, society might be better served if parents and educators would stop using the canard that a four-year degree is always worth the cost outside of a few majors mentioned above. Encouraging students to consider the trades and parents to give their children the money they would spend on a four-year college degree to put a down payment on a house might be a better use of finite economic resources. The alternative of forcing the proverbial square peg into a round hole will condemn another generation to student debt slavery forcing them to put off buying a home or getting married.

Loans Drive Overall Demand

The root of the problem is intervention by the federal government in providing student loans. Since 1965 when President Johnson signed the Higher Education Act tuition, room, and board has increased from $1,105 per year to $18,943 in 2014–2015. This is an increase of 1,714 percent in 50 years. In addition, the Higher Education Act of 1965 created loans which are made by private institutions yet guaranteed by the federal government and capped at 6.8 percent. In case of default on the loans, the federal government — that is, the taxpayers — pick up the tab in order for these lenders to recover 95 cents on every dollar lent. Loaning these funds at below market interest rates and with the federal government backing up these risky loans has led to massive malinvestment as the percentage of high-school graduates enrolled in some form of higher education has increased from 10 percent before World War II to 70 percent by the 1990s. Getting a four-year degree in nearly any academic field seemed to be the way in which to enter or remain in the middle class.

But just as with the housing bubble, keeping interest below market levels while increasing the money supply in terms of loans — while having the taxpayer on the hook for a majority of these same loans — leads to an avalanche of defaults and is a recipe for disaster.
